In the wake of the highly-sensationalized termination of the Britney Spears case, the Legislature enacted sweeping changes in the law and procedures surrounding conservatorships. Judicial attitudes towards conservatorships have also greatly shifted.  Once an important tool to ensure necessary care for those who cannot provide it and protect elders suffering from financial abuse, they are now viewed with suspicion and cynicism. Is this an example of hard cases making bad law, or a necessary course correction for a procedure that can lead to abuse? 

Mr. Martin will analyze the changing landscape of conservatorships.

 

About our Speaker

Mr. Martin has practiced as a civil litigator for nearly 30 years and is a shareholder in the firm of Lurie, Zepeda, Schmalz, Hogan & Martin.  He has been involved in numerous high-profile probate and conservatorship cases, including the Conservatorships of Peter Falk, the Conservatorship, Trust Proceedings, and Wrongful Death litigation regarding Casey Kasem, and the Conservatorship and Trust of Randy Meisner (the founding bassist of the Eagles).  He has drafted legislation allowing family members to obtain access to loved ones who are being isolated, versions of which have been passed in over twenty states.  He has frequently been consulted as a commentator on probate law and conservatorships by media sources such as CNN This Morning, Larry King Live, Nancy Grace, and USA Today.  Mr. Martin has served three terms as the President of the South Bay Estate Planning Counsel.
