Focus Group - California's new Virtual Representation Statute; Did You Get the Notice?

Probate proceedings often call for notice to, and possible consent from, every "beneficiary", which includes minors, the unborn, the incapacitated, and even unknown persons. Virtual representation provides a lawful way to give notice to these persons without having to actually find the person. Proper notice to a valid virtual representative is binding upon the virtually represented. This avoids future challenges from these persons and permits a trustee to take action such as modifications and terminations.
